Cadbury Easter Picnic Terms and Conditions

The following Terms and Conditions are applicable to the sale of tickets to, entry of and attendance at the Cadbury Easter Picnic for 2019 (‘Event’).

'You' and 'your' refer to tickets holders for the Event. 'we', 'us', 'our' and 'Cadbury’ refers to Mondelez Australia Pty Ltd (ABN 78 004 551 473) whose registered office is 75 Dorcas Street, South Melbourne Australia 3205. This ‘Agreement’ means these Terms and Conditions and any other conditions specified by us, our event organiser or authorised ticket provider, whether on our website, Event site, ticketing site, booking forms relating to the Event or on posters displayed at the Event.

Certain laws provide non-excludable statutory guarantees, conditions or warranties for the supply of certain goods or services. Nothing in these Terms and Conditions is to be taken to exclude, restrict or modify any guarantee, condition or warranty that Cadbury is prohibited by law from excluding, restricting or modifying. All other guarantees, conditions and warranties are excluded.

Entry to the Event is deemed acceptance of the terms of the Agreement.

If you do not comply with the terms of the Agreement, you may be removed from the Event by Cadbury, security or police officers without any right to a refund. This is without prejudice to any claim that we may have against you or arising out of your actions.

Cadbury will endeavour to ensure that as many rides and attractions as possible are available for use by guests at the Event. However, Cadbury reserves the right, without prior notice, to close and change the program of rides and attractions. Cadbury in its absolute discretion reserves the right to close the whole or any part of the Event at any time or to restrict the number of persons having access to the Event. The reason for any closure or restriction provided by this condition may include technical or operational reasons, capacity, inclement weather, special events or to ensure the safety and security of guests or if Cadbury reasonably considers the circumstances so require. If the whole Event is closed for any of the reasons set out above, Cadbury will not be required to refund the cost of tickets to the Event, or any attractions or rides.


THE EVENT IS PRIVATE. All persons entering the Event must hold a valid ticket. Tickets to the Event are sold subject to the Agreement.

It is a condition of sale that tickets are not transferable, not for re-sale, will become automatically void on any transfer of value and are only valid if purchased from (Eventopia) or provided by Cadbury. Only persons authorised by Cadbury or its Event Organiser are permitted to sell or offer for sale any items to guests within the Event grounds.

No refunds or exchanges will be available unless the Event is cancelled in advance of commencement of the Event. This is an all-weather Event. No refunds will be made if you choose not to attend due to inclement weather. For the avoidance of any doubt, pre-booked tickets are non-refundable in the event that entry is refused for any reason referred to in the Agreement.

Cadbury will not replace lost, destroyed, damaged or stolen tickets.

BARCODED TICKETS are required for entry to the Event, for access to the Easter Egg Hunts (referred to below) and to access rides at the Event (online purchases). You will be provided with one barcode per ticket holder for entry to the Event and a Hunt (if eligible) and a separate barcode ticket for each ride wristband purchased online. Children who have a hunt time allocated to their entry barcode will be required to use their entry barcode to access their allotted hunt meadow at the time indicated on the ticket. You can print your barcoded tickets, or carry them on your smartphone, and bring them to the Event. The barcode will be required for scanning at entry to the Event and on entry to the Hunt Meadows. NO ENTRY WILL BE PERMITTED WITHOUT A VALID BARCODED TICKET.

If tickets are bought on behalf of other guests, the buyer will be deemed to have accepted the terms of the Agreement on behalf of every guest and shall ensure that the terms of the Agreement are complied with by each person in the group. Tickets must be retained at all times and submitted for inspection if required by Cadbury.

No child or children under the age of 12 will be admitted to the Event unless they are accompanied by an adult aged 18 years or over and such child or children whilst on site must remain under the control or supervision of an adult at all times. For the attention of parents and guardians: please do not leave your child unattended at the Event and when experiencing rides as we are unable to look after them.

If entering the Event as an adult, ID to prove legal age must be shown if required or on demand.

For duty of care reasons, and to be in keeping with the family-based nature of the Event, “Children” tickets can only be purchased in conjunction with an adult ticket or by an adult who has already purchased a ticket. Children between the ages of 3 and 12 are eligible for a ‘Child’ ticket. Children under the age of 3 do not require a ticket to enter the Event. Cadbury reserves the right to refuse entry to those who present as “children” at the Event yet fail to satisfy our personnel that they are indeed accompanied by an adult aged 18 years or over in possession of a valid ticket.

If we determine that the price of tickets set out on the website of our ticketing agent, Eventopia, is in error, persons who have purchased tickets will be contacted. If the error has resulted in the purchaser being overcharged, the amount overcharged will be refunded. If the error has resulted in the purchaser being undercharged, we reserve the right to charge the purchaser the balance of the correct ticket price. If ticket holders disagree, tickets can be cancelled and a full refund provided net of the non-refundable booking fee.
No refunds will be given if the ticket holder cannot attend the Event or any part thereof for whatever reason.

Cadbury reserves its right to cancel the Event at any time due to a Force Majeure Event, which in Cadbury’s sole discretion makes it logistically impossible to continue to operate the Event. “Force Majeure Event” shall mean anything outside Cadbury’s or the Event Organiser’s reasonable control, including without limitation, fire, bad weather, damage to Event Site caused by bad weather, rain, flood, drought, storm, lightning, act of god, explosion, sabotage, accident, labour dispute, council or police rulings or war.
Tickets to the Event cannot be used as part of any marketing, media or sales promotion whether commercial or non-commercial without Cadbury’s prior written consent.

You will follow all directions of Event staff at all times during the Event.

Community standards of behaviour are expected at all times during the commute to the Event, during the Event and during the commute home from the Event.

Cadbury, its Event Organiser or the Event venue provider, acting reasonably at all times, reserve the right, to refuse admission to the Event, ban from entry to the Event, or remove from the Event any person for any reasonable cause or any person whose presence or behaviour may affect the enjoyment and/or safety of other guests or staff or who acts in an inappropriate and/or undesirable manner.

Your dress and appearance must be suitable for a family event. You must wear appropriate clothing and shoes at all times whilst at the Event.

All bags/containers may be subject to a full search.

Ticket holders agree to comply with all Event security arrangements, as well as those of the venue provider, including personal searches (if deemed necessary by Cadbury, its Event Organiser or venue provider). All GLASS, ALCOHOL, ILLEGAL DRUGS, WEAPONS, FIRE WORKS, or DANGEROUS ITEMS are prohibited and will be confiscated. No claim may be made against Cadbury or the venue provider for items confiscated. Persons found in possession of illegal drugs, weapons or dangerous items will be removed from the venue.

The Event is a NON SMOKING Event. Smoking (including of e-cigarettes) will not be permitted within the Event area and within the vicinity of the Event.

The Event area is a GLASS FREE ZONE and no glass must be brought into any part of the Event. Animals will not be permitted onto the Event site, with the exception of guide dogs and the entertainment as provided by the Event.


A limited number of Easter Egg Hunts will take place at the Event at pre-scheduled times depending on their age group (‘Hunt’). All participants in each Hunt must be between the ages of 3-12 years.

Eligible participants may only enter one hunt, suitable to their age group, as determined by their age at their last birthday.

All participants must have a valid barcoded entry ticket to the Event (as described above) and be able to provide this to Event staff at the entry to the hunt meadow. Participants will only have access to the Hunt at the time and meadow designated on their entry ticket. One ticket, one entry, one child. If a participant does not participate or does not arrive in time to participate in their designated Hunt, their Hunt ticket will be forfeited.
Hunt entry tickets may only be purchased by persons 18 years and over who are the parent, legal guardian or person responsible for the child(ren) entering the Hunt (the “Responsible Person”).

An adult of 18 years or over must accompany children aged 3 and 4 years old on the Hunt. If they are unable to do so the child(ren) will forfeit their Hunt.

There is no guarantee on the quantity or minimum quantity of eggs each child will receive in a Hunt. This will remain at Cadbury’s discretion. The maximum eggs per child per Hunt is one ‘official Event Hunt bucket’ full. An ‘official Event Hunt bucket’ or equivalent will be provided to each participating child on presentation of a valid ticket at the entry to the Hunt Meadows.
In the spirit of creating a family friendly experience for participants, the Hunts are for participating children only. Responsible adults accompanying 3 and 4 year olds on the Hunts will not be permitted to pick up eggs on behalf of a child.

As stated above, any behaviour deemed inappropriate or dangerous to the safety of other participants will result in offenders being removed from the Hunt meadows. The same terms relating to behaviour at the Event and our liability as stated above are applicable to the Hunts also, as are all other terms and conditions stated in this Agreement.

Urgent medical treatment may be administered by a qualified medical practitioner in attendance at the Hunt if considered necessary and appropriate by the attending qualified medical practitioner in the event that the participant’s Responsible Person cannot be reasonably quickly located.


Cadbury takes no responsibility for food purchased from food vendors at the Event.
Food and drink including chocolate available at the Event may contain allergens that could cause injury to susceptible individuals therefore individuals should make their own enquiries of food vendors.


Cadbury or other authorised parties may carry out photography and/or video recording at the Event, which may feature people attending the Event. You agree that Cadbury or any authorised party may use such images in perpetuity in any promotional, advertising or publicity material in any format whatsoever. You further agree that copyright in these materials rests with Cadbury or such authorised party (as the case may be).

Unless it is expressly prohibited, you are permitted to take photographs and recordings within the Event provided that these are solely for private use and are not sold or used for any commercial or public purpose.


For access to rides and certain activities, you must have a valid ride wristband or single ride ticket. For information on which rides require a ride ticket or wristband, please refer to [Cadbury Australia website] or information booklet and signage at the event. If you have purchased a ride wristband, you will be provided with a wristband upon presentation of your barcoded entry ticket to the Event. For those who want to purchase a ride wristband or single ride ticket on the day of the Event they can do so at the Ride Sales marquee inside the Event.
Upon entry to the Event a valid ride ticket will be exchanged for a wristband to be fitted at the designated area near the entrance to the Event and must be worn at all times. Wristbands must remain intact to gain entrance to the rides. Damage to a wristband (even if accidental) will render it invalid and access to the rides denied.
Each ride / activity is subject to individual ride / activity participation requirements (height & age restrictions, children accompanied by an adult, capacity restrictions) and must be adhered to. It is the responsibility of the attendee to make themselves aware of these rules and adhere to these requirements.

Cadbury reserves the right to refuse access to any ride or activity if it is deemed any of the above requirements or safety concerns are not being met.

Without limiting any other provision of these Terms and Conditions, any behaviour in and around the rides and other Event activities deemed by Cadbury or the Event Organiser as inappropriate or dangerous will not be tolerated and patrons may be asked to leave.
At no point should any person under the age of 18 be left unattended in any area of the Event including the rides and activities. Anyone under 18 is the sole responsibility of their accompanying “responsible adult”.

Please note that queues for rides and activities can be long. Wristbands and single ride tickets do not guarantee access to all rides at all times. It is your responsibility to attend rides during the duration of the Event with enough time to reasonably expect to be granted access before the end of the Event.

We reserve the right to add, withdraw or substitute artists, rides, activities, vary any advertised program, change venue and vary audience capacity. No claim for compensation will be made in the event that the program is varied.


Entry is at the ticket holder’s own risk. We will not be liable for any loss, injury or damage sustained upon entering or attending the Event – to the extent allowed by the law.
Cadbury accepts no responsibility for any loss, injury and/or damage suffered by you as a result of any event outside of its reasonable control. This does not affect your statutory rights.

Cadbury will not be responsible whatsoever for any lost property (including without limitation personal property such as bags, money or other personal items) of ticketholders.

You will be liable for any loss or damage caused at the Event by you or your invitees.

You agree to indemnify and hold Cadbury, its employees, sub-contractors and agents, harmless from any demands, loss, liability, claims or expenses (including legal fees) due to or arising out of your attendance at the Event or any breach by you of this Agreement.


We care for our environment and community. Please be respectful and place any litter in the recycle or other bins provided around the Event venue.

Please respect the Werribee Park space and surrounds and do not create excessive noise or litter while traveling to and from the Event.

The grounds of Werribee Park do not allow any pegging into the ground. Any seats or small tents brought must not require pegs. For patrons who do wish to bring small tents that don’t require pegging these will be able to be set up but in the area allocated.

Werribee Park requires that you or any children accompanying you do not play in the garden beds or climb any trees so as to avoid causing harm or any damage to the trees and garden areas. Anyone seen doing so may be asked to leave the premises and cover any costs associated with any damage sustained.
